Acceptable Use Policy
1. Reporting Suspected Violations
Users of the SwiftFox CRM platform are encouraged to promptly report any suspected violations of this AUP or any suspicious or unauthorised activity. To report violations, please contact our support team at firstname.lastname@example.org
2. No Disruption
You agree not to:
a. Use the SwiftFox CRM Platform in a manner that adversely affects the normal operation, privacy, integrity, or security of another's property. Another's property includes another's account(s), domain name(s), URL(s), website(s), network(s), system(s), facilities, equipment, data, other information, or business operations.
b. Employ any automated system, such as "robots," "spiders," or "offline readers," that generates an excessive volume of request messages to our servers within a given period, surpassing what a human can reasonably produce using a conventional browser.
c. Engage in activities with the SwiftFox CRM Platform that cause damage, disable, overload, or hinder the functioning of our websites or interfere with the usage experience of other users.
d. Attempt to gain unauthorised access to the SwiftFox CRM Platform.
e. Use another user's unique login credentials to access the SwiftFox CRM Platform, including sharing or reusing login credentials among multiple users.
f. Access the SwiftFox CRM Platform through means other than our designated interface.
g. Utilise the SwiftFox CRM Platform to gain unauthorised access to, use, monitor, or make unauthorized reference to another's property, unless you have obtained explicit prior consent to do so.
h. Engage in any activity with the SwiftFox CRM Platform that could result in the blacklisting of SwiftFox IP addresses, SwiftFox domains, or SwiftFox customer domains.
3. Proper Usage of the SwiftFox CRM Platform
When utilising the SwiftFox CRM Platform, you are expected to ensure that your use of the SwiftFox CRM Platform, whether directly or indirectly, does not involve or result in any of the following:
- Engaging in behavior that is threatening, abusive, harassing, stalking, or defamatory.
- Participating in deceptive, false, misleading, or fraudulent activities.
- Infringing upon another person's privacy or violating their legal rights, including rights of privacy and publicity.
- Uploading or sharing vulgar, obscene, indecent, or unlawful material.
- Violating the intellectual property rights of third parties.
- Publishing, posting, uploading, or distributing software, music, videos, or other materials protected by intellectual property laws or by rights of privacy or publicity without obtaining the necessary rights and consents.
- Uploading files that contain viruses, corrupted files, or any other similar software or programs that may harm the operation of another person's computer.
- Downloading files that you know or reasonably should know cannot be legally distributed in that manner.
- Falsifying or deleting author attributions, legal or proprietary designations, or labels indicating the origin or source of uploaded files.
- Violating the usage standards or rules of any entity affected by your use, such as ISPs, ESPs, or news or user groups. This includes actions like circumventing or exceeding equipment use rights and restrictions, as well as location and path identification details.
- Using the service in a manner that violates any applicable local, state, national, or international laws or regulations in your or your email or text message recipient's country of residence.
When using SwiftFox CRM, you are also expected to ensure that you:
a. Refrain from encouraging, promoting, facilitating, or instructing others to engage in illegal activities.
b. Prohibit hate speech, violence, or discrimination based on race, color, sexual orientation, marital status, gender or identity expression, parental status, religion or creed, national origin or ancestry, sex, age, physical or mental disability, veteran status, genetic information, citizenship, or any other characteristic protected by law. Organizations or individuals promoting, encouraging, or facilitating hate speech, violence, or discrimination, whether through their own content or the distribution of user-generated content, are strictly prohibited from using the SwiftFox CRM Platform. This prohibition applies regardless of whether the service is specifically utilised for such prohibited activities. Violation of these standards may result in termination of your use of the SwiftFox CRM Platform.
c. Take responsibility for moderating user-generated content or user activity on your platform or service. Any user-generated content that violates these guidelines may result in termination of your use of the SwiftFox CRM Platform.
d. Utilise the SwiftFox CRM Platform solely for your internal organization purposes and refrain from:
- Willfully tampering with the security of the SwiftFox CRM Platform or customer accounts.
- Accessing data on the SwiftFox CRM Platform that is not intended for you.
- Logging into a server or account on the SwiftFox CRM Platform without proper authorisation.
- Attempting to probe, scan, or test the vulnerability of any part of the SwiftFox CRM Platform or breach its security or authentication measures without proper authorisation.
- Willfully rendering any portion of the SwiftFox CRM Platform unusable.
- Leasing, distributing, licensing, selling, or commercially exploiting the SwiftFox CRM Platform or making it available to third parties, except as explicitly permitted under your subscription to the SwiftFox Service.
4. Prohibited Email and SMS Actions
The following email and SMS actions are strictly prohibited when using the SwiftFox CRM platform:
a. Sending unsolicited commercial messages (spam) to individuals or organisations who have not expressly consented to receive such communications via email or SMS.
b. Engaging in phishing activities to deceive or fraudulently obtain personal or sensitive information from recipients via email or SMS.
c. Sending bulk emails or SMS messages or engaging in mass marketing campaigns without adhering to relevant laws and regulations, such as obtaining consent and providing opt-out mechanisms.
5. Email and SMS Opt-Out Requirements
Users of the SwiftFox CRM platform must comply with email and SMS opt-out requirements, including:
a. Including a clear and prominent unsubscribe instruction in all marketing emails and SMS messages, allowing recipients to easily opt-out from future communications.
b. Honoring opt-out requests promptly and removing opted-out recipients from future marketing campaigns.
6. Telephone Marketing and Advocacy Calling
Users of the SwiftFox CRM platform engaging in telephone marketing or advocacy activities must comply with applicable laws and regulations, including:
a. Complying with relevant do-not-call registries and respecting recipients' preferences to opt-out of telephone marketing or advocacy calls.
b. Providing accurate caller identification information to recipients during telephone marketing or advocacy calls.
7. SwiftFox Trademark Use
Users of the SwiftFox CRM platform must not use the SwiftFox name, logo, or trademarks without prior written permission from SwiftFox CRM. Unauthorized use may infringe upon trademark rights and is strictly prohibited.
8. Consequences of Violations
Failure to comply with this AUP may result in the following actions:
(a) Warning: A warning may be issued to the user, highlighting the violation and reminding them of their obligations.
(b) Account Suspension: In cases of serious violations, your account may be suspended pending further investigation.
(c) Account Termination: Repeated or severe violations may result in the permanent termination of your account, including the loss of all data and access to the Platform.
Please note that we may disclose information regarding your use of the SwiftFox CRM platform to comply with any applicable law, regulation, government request, court order, subpoena, or other legal process. In the event of such a required disclosure, we will notify you, unless we are required to keep the disclosure confidential.
In addition to the above consequences, serious violations may lead to legal actions as deemed appropriate, including but not limited to civil or criminal proceedings.
Amendments to the AUP
We reserve the right to update or modify this AUP at any time. Any changes will be communicated to users through appropriate means, such as email notifications or announcements on the Platform. Continued use of the Platform after such changes indicates your acceptance of the revised AUP.
